License Agreement in the Form of an Offer

Dear user, please carefully review these rules before continuing the process and agree to their terms.

The company 3dbuy (hereinafter in the text "we", “our”, “us”, “our company") is a Russian project that obtains licenses from authors of 3D models and provides the opportunity to share their works and grant rights to use these models to Users (sublicensees) who wish to gain access to them using our service.

When registering an Account on our website https://3dbuy.ru/, you need to familiarize yourself with, understand, and accept our Offer for using the service for users (sublicensees) in the presented form.

If you do not accept these terms of use, please do not use our service. By checking the box "I have read and accept the service rules" and creating an account on our website https://3dbuy.ru/, you automatically agree to these terms.

Please read them carefully before proceeding and accepting.

1. DEFINITIONS

1.1. This document, which is posted on the Website, is accepted (agreed) by the User and is called the "Agreement". 

To prevent ambiguity and possible misunderstandings in interpreting this Agreement, the parties that signed it agreed that the terms listed below will have the following meanings:

1.2. "User" means an individual or legal entity (individual entrepreneur) that has entered into a sublicense agreement with 3dbuy under the Terms of Service for Users.

1.3. "Registration" means successful completion of the registration form on the 3dbuy.ru Website, which allows the User to create their Account.

1.4. After registration and/or login to the Website, the User gains access to their personal section called "Account". This section contains data related to the User, including their information and internal Service data, which allows the User to use the Service's functionality and purchase licenses for using materials.

1.5. "Website" - the Website under the name 3dbuy.ru located on the Internet and using the domain name https://3dbuy.ru/.

1.6. Database, created and structured by 3dbuy, contains 3D models, textures, materials, which are the result of intellectual activity. Access to this database is provided through the Website.

1.7. "Service" means a set of functions that we provide to the User of our Website after their agreement to this Offer to meet the User's needs. For example, this can include the ability to upload and download materials, organize materials in a personal account, view materials, and so on.

1.8. "Content" - the content of the Website consisting of photos, text, and other materials approved by the administrator and posted by Authors for access by an unlimited number of Website visitors.

1.9. "Model" - an object of copyright created by the Author using their individual creative work, uploaded by them to the Website Database in accordance with the Terms of Use for Authors. These objects are the result of three-dimensional modeling and also contain associated scripts, textures, and other materials intended for use by the User in accordance with this Offer.

The Author is also recognized as a person lawfully possessing the exclusive right to any copyrighted work acquired from another person and uploaded by them to the Website Database in accordance with the Terms of Use for Authors. 

1.10. "Material" - an object of copyright created by the 3dbuy team using their individual creative work, uploaded by the Administration to the Website Database in accordance with the Terms of Use.

1.11. "Status" - the status of the User's Account, which is assigned by 3dbuy depending on how the User uses the Website.

The following statuses exist: "User"; "3D Visualizer"; "Designer"; "Author"; "Manufacturer"

A more detailed definition of each status is provided in the "Statuses" section below in clause 6.

1.12. "Spam" – Content containing any materials of an advertising nature not allowed by 3dbuy, links to malicious websites, and any unlawful or other undesirable information.

1.13. "Flood" – Content not related to the topics of the Website sections where it was posted by the User, as well as meaningless or senseless, obscene, or aimed solely at increasing the User's personal rating posts.

1.14. "Subscription" – the acquisition by the User of a sublicense for access to the Website database for a limited period.

Depending on the subscription level, the User can download models and materials to any iOS, Android, and Windows device and use them without an internet connection.

1.15. "Downloads" – Subscription restriction, the number of content items downloaded from the Website database, one download equals one unit of content.

1.16. "Perpetual downloads" – the number of content items downloaded from the Website database, one download equals one unit of content, these downloads have no expiration date.

1.17. "Daily limit" – subscription restriction, the total number of content downloaded per day from the Website database.

1.18. "Promo code" – an individual and/or permanent code that can be used to receive additional downloads on your account under certain conditions.

1.19. "Referral link" – an individual and permanent link to your account, through which registration can result in additional downloads being added to your account.

1.20. "Leeching" – active downloading of files, including situations where such actions violate the Website rules. More details https://3dbuy.ru/forbidden

1.21. "Ban" – temporary or permanent blocking of the User (their account) for violating the Website rules. More details https://3dbuy.ru/forbidden

1.22. "Electronic payment" — payment for orders by the User through the Bank in real time when placing an order or after its approval between us and the User. Payment is made using electronic payment systems. To make an electronic payment, the User uses an e-wallet or a bank card. Under this Agreement, interaction between the User and electronic payments is not considered.

1.23. "Internet acquiring" — technology that ensures the ability to accept bank cards for payment via the Internet.

1.24. "Email" - noreply@3dbuy.ru

1.25. "Website" - https://3dbuy.ru/

1.26. "Product" - Goods or services, the sale of which is not prohibited or restricted by the legislation of the Russian Federation, posted by us on our Website, including technical support services.

1.27. If the Agreement contains terms that are not defined above, they will be interpreted in accordance with the laws of the Russian Federation.

2. SUBJECT OF THE AGREEMENT

2.1. This offer (hereinafter also referred to as the Agreement) constitutes a simple non-exclusive license. In accordance with this Agreement, 3dbuy grants the User a non-exclusive sublicense to use the paid subscription services, and the User pays for the corresponding license obtained from 3dbuy.

2.2. In addition to granting sublicenses, 3dbuy provides the User with the ability to use the service, which includes the following functions:

2.2.1. Search and view models/materials and related information.

2.2.2. View informational content posted on the website.

2.2.3. Registration and/or login to the website.

2.2.4. Posting and displaying informational content on the website, including texts, links, images, audio and video files, data, and/or other information.

2.2.5. Access to Models/Materials and the ability to download them.

2.2.6. Use of other functionalities of the Service is permitted.

2.3. The User agrees that when creating or using the result of intellectual activity through publishing information in the Content, the User obtains Author status and transfers the exclusive right to such result of intellectual activity to 3dbuy free of charge under the terms of a simple non-exclusive license with the right for 3dbuy to issue an unlimited number of further sublicenses, including on a paid basis.

2.4. As an incentive from 3dbuy, the Author for posting results of intellectual activity receives free of charge the right to make 5 downloads (the ability to download 5 units of content from the Website created by other authors), with no time limit.

2.5. 3dbuy provides Users with the opportunities specified in clause 2.2 of the Agreement under a paid subscription according to the tariffs:

2.5.1. No subscription – purchase of downloads for individual content units without a time limit.

2.5.2. Basic subscription – purchase of a certain number of content downloads for a limited time.

2.6. The User agrees that the use of a login and password serves as proper and sufficient identification when logging into the personal account, confirms their right to perform operations in the Personal account, and is considered equivalent to the User's own signature. All operations and transactions performed in the Personal account are deemed completed in writing. If the User provides third parties with access to their account on the Website using their login and password, the User is fully responsible for any actions and omissions by such persons as if they were their own. The User must ensure the secure and confidential storage of their login and password for accessing the Personal account. In case of their loss or access by third parties, the User undertakes to immediately notify Us for subsequent data changes.

2.6.1. 3dbuy, being the developer and owner of the Website software, grants the User, under this Agreement, the right and access to use the software after registration.

2.6.2. Access to the software is provided via any of the supported web browsers: Yandex Browser, Mozilla Firefox, Opera, Google Chrome.

2.7. By agreeing to the terms of this Agreement, the User warrants to 3dbuy that:

2.7.1. The User provided accurate data identifying the User during registration as such on the registration page and accurate User data when making payments for services;

2.7.2. The User concludes the Agreement voluntarily, and the User a) has fully read the terms of the Agreement, b) fully understands the subject of the Agreement, c) fully understands the significance and consequences of their actions regarding the conclusion and use of the Agreement under these conditions;

2.7.3. The User possesses all rights and authority necessary to conclude and use the Agreement.

3. ACCEPTANCE OF THE OFFER AND TERM OF THE AGREEMENT

3.4. After completing the registration and checking the box "I have read and accept the service rules", the User confirms that they have read all the provisions of this Agreement and fully accept them without any exceptions or reservations.

3.5. Acceptance of the terms of use by Users means that the two parties, namely the User and 3dbuy, have concluded a written agreement.

3.6. This Agreement between the User and 3dbuy becomes effective from the moment the User registers on the Website.

3.7. 3dbuy may amend this Agreement as follows: 3dbuy publishes a new version of this Agreement on the Website.

If the User does not express their disagreement with these changes within 10 (ten) days (by sending a message to the Website support service), the Agreement is considered accepted by the User in the new version.

The User has the right not to accept the amended Agreement after we post the new version of the Agreement on the Website, and such disagreement will result in the immediate termination of the User's rights and obligations, including rights to use models/materials.

4. OBLIGATIONS AND RIGHTS OF 3DBUY

4.1. We undertake to maintain the normal and uninterrupted operation of the Website, as well as maintain and update it to ensure Users' access to the Service and its normal use. Provide the User with the Website on an "as is" basis.

4.1.1. Send the User a login and password to access the Personal account on the Website. We are not responsible for the security of the User's logins and passwords.

4.2. Provide the User with advisory support on issues related to the operation of the software.

4.2.1. Provide the User with technical support regarding the content posted on the Website.

4.2.2. Within 1 (one) hour from the moment of receiving payment in our favor, send the User information about the order received in our favor and confirmation of payment.

4.2.3. Respond to a request received by the technical support service within 24 (twenty-four) hours from the moment it is received. If the request is received on weekends or holidays, the countdown of this period begins at 10:00 a.m. on the next working day.

4.2.4. Ensure availability 99% of the time, with possible technical interruptions determined by the maintenance plan. At the same time, we are not responsible for the proper functioning of the partners' services we use.

4.3. We undertake to take all necessary measures to protect Users' personal data in accordance with the legislation of the Russian Federation and our privacy policy.

4.4. We have the right to make changes to the Website, its design, and add new Services at our discretion without prior consent of the Users. We may also suspend access to the Website while performing such work.

4.5. 3dbuy may actively promote the Website and the Service by placing advertisements on any page of the Website, including contextual advertising, banners, interactive videos, animations, and other types of advertising.

4.6. 3dbuy has the right to assign certain Statuses and visit User profiles.

4.7. In case the User violates this Agreement, 3dbuy may send a warning to this User and unilaterally, extrajudicially terminate the Agreement concluded with them in whole or in part.

These measures may also include suspending the User's access to the Website and Service, deleting their Account and/or Content, changing the Account Status, or refusing to assign a Status to such User.

4.8. 3dbuy has the right to control, edit, and delete Content at its discretion, including removing offensive language and correcting errors, without prior consent of the User.

4.9. At its discretion, 3dbuy may allow Users to post advertisements on its website and copy and use information and content presented on our site on other platforms, but only with a mandatory link to the 3dbuy website and only with prior written consent from 3dbuy.

4.10. 3dbuy has the right to change the prices for its services at its discretion. The procedure for changing prices is in accordance with clause 3.4 of this agreement.

4.11. 3dbuy may at any time at its discretion request documents and other information from the User to confirm their identity. This is necessary to prevent and detect improper use of 3D models and materials. Possible documents and information that may be requested include, but are not limited to, an identity document such as a passport or international passport, the User's portfolio or a link to their website, and other details and documents.

4.12. We have the right at any time to check the User's activity for compliance with this Agreement and site rules, and the User agrees to 3dbuy checking their account.

4.13. 3dbuy has the right to place advertising material, including the logo, trade name, other means of individualization, QR codes, product descriptions, hyperlinks.

5. USER RIGHTS AND OBLIGATIONS

5.1. The Website and the Service may be used by the User in accordance with this Agreement.

5.2. Each User may upload and use all bonus credits in accordance with this Agreement, including for promoting their Account's promo code.

5.3. The User may purchase a subscription at a tariff that allows downloading and using at least 30 Models in total within 1 calendar month.

5.4. The User may upload and use Models in accordance with this Agreement, after fulfilling all conditions.

5.5. The User has the right to receive Statuses in accordance with the Agreement and thus gain access to Website and Service functions related to each Status.

5.6. The User may contact 3dbuy with their wishes, suggestions, questions, and claims related to the Website and Service, as well as in other situations where prompt communication with 3dbuy specialists is required.

5.7. The User may request permission from 3dbuy to place advertisements on the Website.

5.8. The User may request permission from 3dbuy to copy and use Content located on our Website on other websites.

5.9. The User has the right to recalculate or refund overpayment in accordance with applicable laws of the Russian Federation and this Agreement.

5.10. The User may post Content provided that it:

5.10.1. Complies with the laws of the Russian Federation and the country where the User is located.

5.10.2. Does not contain acts of violence or materials of obscene, offensive, vulgar, harmful, threatening, defamatory, deliberately false, or pornographic nature.

5.10.3. Does not harm the honor, dignity, and reputation of other persons and does not contain any unfounded assumptions about third parties, unverified facts, or mention such persons in a way that could reduce demand for their goods and services.

5.10.4. Does not incite racial, religious, interethnic, interethnic conflicts, or social tensions.

5.10.5. Does not contain violations of intellectual property rights (exclusive rights, copyrights, related rights, industrial property rights (patents), trade secrets, trademarks and service marks, trade names, etc.), and does not copy informational content created by other Users.

5.10.6. Does not violate the rights of minors.

5.10.7. Does not contain pornographic, sexually exploitative, obscene, offensive, degrading, or other unacceptable content;

5.10.8. Does not contain information that may be harmful to the health, safety, or well-being of other persons;

5.10.9. Does not contain advertising or promotion of prohibited goods, services, or activities;

5.10.10. Does not contain viruses, malware, or other computer codes, files, or programs that may harm the operation of another person's computer or system;

5.11. Does not violate the legislation of the Russian Federation or the rights of third parties;

5.12. Does not violate the terms of use of the platform or other rules established by the platform administration.

5.13. Strictly adhere to and not violate the terms of this Agreement, as well as ensure the confidentiality of commercial, technical information, and personal data received in cooperation with 3dbuy, in accordance with the terms of this Agreement.

5.14. The User confirms that they have given consent to the processing, transfer, and storage of personal data by 3dbuy.

6. STATUSES

Persons registered on the Website and who have accepted the terms of the Agreement may choose or receive various statuses, each providing certain rights and obligations.

6.1. Status "User" is assigned to a person after successful Registration with 3D visualizer rights and acceptance of the Agreement, granting them the rights to view the site and download free materials.

6.2. Status "Author" is assigned to the User after uploading their Model to the Website Database, also granting them certain rights and obligations, viewing the site, downloading free and paid materials.

6.3. Status "3D Visualizer" is assigned to the User after making a purchase on the Website, which also grants them certain rights and obligations, viewing the site, downloading free and paid materials.

6.4. Status "Designer" is assigned to a person after successful Registration with Designer rights and acceptance of the Agreement, which also grants them rights and obligations under it. Free image uploading is available, model upload and access to paid content on the site are not available.

7. LICENSE FOR USE OF MODELS AND MATERIALS

7.1. When the User receives a Model/Material from the Website Database, 3dbuy grants them a personal, non-exclusive (simple), revocable license to use worldwide throughout the entire term of the exclusive right according to the following parameters:

7.1.1. Recording Models on electronic media, including CD, DVD disks, flash drives, portable hard drives, as well as saving them in computer or smartphone memory.

7.1.2. Distribution - sale or any other transfer of Models/Materials, as well as distribution of copies involving the creation of the Model/Material in two dimensions by applying its image on various media (for example, posters, t-shirts, etc.), excluding electronic media such as hard drives, etc.

7.1.3. Public display - any display of the original or a copy of the Model/Material on screens in places with free access or in places with a large number of people who are not family members, including for advertising purposes.

7.1.4. Public performance - presentation of the Model/Material live or using technical means (radio, television, etc.) in places open to the public or in places where there are a significant number of persons not belonging to the family circle, including for demonstrating a product for sale in a store.

7.1.5. When downloading a Model/Material from the Website database, the User receives a non-exclusive (simple), personal, revocable license for worldwide use for the entire term of the exclusive right in accordance with the following rights:

7.1.5.1. Import of originals or copies of Models/Materials made in any material form, including three-dimensional or two-dimensional, as well as electronic media on which the Models/Materials are located across customs borders of countries.

7.1.5.2. Rental, including leasing or lending (free use) of Models/Materials made in any material form, including three- and two-dimensional.

7.1.5.3. Retransmission, which includes reception and simultaneous broadcasting (including via satellite) or by cable of a complete and unchanged radio or television program with the Model/Material or its significant part, which was broadcast or by cable by a broadcasting organization.

7.1.5.4. Making a two-dimensional (three-dimensional) image of the Model/Material available to the public in such a way that any person can access the two-dimensional image of the Model/Material from any place and at any time of their choice, for example, by uploading its image as part of an Internet site design on the Internet or as part of their own portfolio on the Internet.

7.1.6. Use of the downloaded Model/Material to create derivative works, including:

7.1.6.1. Practical implementation of an architectural, design, urban planning, or landscape project including the Model/Material in three or two dimensions, including the construction of a house whose Model/Material was available in the Website Database.

7.1.6.2. Processing the Model/Material only into a two-dimensional work, creating a derivative two-dimensional work using the Model/Material and their own creative contribution, including creating an image (render) of an interior design project using the image of Models/Materials, as well as using the derivative two-dimensional work in all ways mentioned in clause 7.1.

7.1.6.4. Use of the Model/Material as part of a complex object, for example, in an audiovisual work (film, advertising video, etc.), theatrical performance, but without the right to use it as part of a database.

7.1.6.5. Use of the Model/Material in a computer game, console game, smartphone game, or any other game for an electronic device.

7.1.7. In case of violation of this License's conditions, you are responsible to the Authors of the Models.

8. PRICES AND PAYMENT PROCEDURE

8.1. The cost of the Tariff depends on the chosen subscription option. More about tariffs

8.2. The subscription period that can be purchased by an individual ranges from one (1) to six (6) calendar months.

8.3. Each of the three types of subscriptions has its own daily limits, which are updated daily at 00:00 Moscow time (server time). "No subscription" has a daily limit of 20 downloads, "Basic" - from 30 downloads, "Personal" - an individual limit, which can vary from 20 to 300 downloads per day. More detailed information can be found on the subscription page.

8.5. The price includes the cost of the License, website and database maintenance, and also depends on the daily access limit.

8.6. To consider the payment successful, the funds must be credited to 3dbuy's account or to the accounts of payment systems indicated on the website for payment.

8.7. Prices include VAT, if applicable.

8.8. Each time they log into the Personal Account, the User must review the tariffs and limits posted in the User's Personal Account. 3dbuy is not responsible for possible financial losses of the User associated with failure to review or untimely review of new (individual) 3dbuy tariffs.

9. TERMINATION OF THE AGREEMENT

9.1. The Agreement comes into force on the date of its conclusion (from the moment of successful registration) and is valid indefinitely.

9.2. Either Party may at any time unilaterally and out of court fully terminate this Agreement, but must notify the other Party by email no later than 10 calendar days before the termination date. Only after such notice is the Agreement considered terminated.

9.3. The User has the right to a refund for the unused period in proportion to the remaining number of perpetual downloads or if the subscription has not been used.

9.3. Termination of this Agreement means termination of the license to the Models/Materials granted to the User. After termination, the User no longer has the right to use the Models/Materials referred to in this Agreement.

9.4. Licenses for Models/Materials that the User obtained for a fee during the subscription period cannot be revoked upon termination of the Agreement, except in cases of violation by the User of the terms of the Agreement or if the Authors of these models/materials themselves revoke such Licenses in accordance with the Terms of Use for Authors.

9.5. All disputes between the User and 3dbuy are resolved through negotiations and written claims.

9.6. 3dbuy undertakes to review the User's written claim by email within 14 business days from the date of the dispute.

9.7. 3dbuy undertakes to notify the User of the results of reviewing their claim by email no later than 14 business days from the date of receipt of the written claim from the User.

9.8. If the User's claim is satisfied, 3dbuy does not compensate for lost profits or moral damages, but makes a compensatory payment to the User's account or cancels the disputed transaction and restores the User's account balance to the state it would have been in if the disputed transaction had not taken place. Other trading operations of the User on their trading account are not considered.

9.9. In case of a dispute not described in this Agreement, 3dbuy, when making the final decision, is guided by generally accepted world practice and the principles of fair settlement of disputes.

9.10. All disputes under this Agreement shall be considered at the location of 3dbuy.

9.11. 3dbuy has the right to unilaterally out of court withdraw from the Agreement by sending a notice, with the termination date being the date of sending the notice:
a) if any of the representations proves to be false, invalid, inaccurate, or misleading;
b) if the User commits material breaches of contractual obligations, such as providing inaccurate information, incorrect profile completion in the Personal Account, violation of exclusive or other rights of third parties;
c) in other cases provided by law or the contract.

9.12. 3dbuy informs Users that the site is commercial and intended for the use of models and materials for commercial purposes. Therefore, the provisions of consumer protection law, in particular the Law of the Russian Federation of 07.02.1992 N 2300-1 "On Consumer Protection", do not apply to relations arising under this Agreement. Users acknowledge that all services and materials are provided exclusively for commercial purposes, and responsibility for the use of information lies solely with them. This agreement is governed by the civil legislation of the Russian Federation and the terms set forth on the site and does not provide any warranties or obligations on the part of 3dbuy regarding consumer protection.

10. LIABILITY OF THE PARTIES

10.1. The parties understand that the core of the Site System is software, and we do not provide any warranties, express or implied, that the System will meet the User's requirements or expectations, will meet the User's goals and objectives. Access to the System is provided under the globally accepted "As Is" principle. The partner uses the system at their own risk. 3dbuy does not assume responsibility for the System's compliance with the purpose of use or the economic expectations of Users.

10.2. 3dbuy is not responsible for any consequences of using the Website and the Service, as well as for their compliance with the subjective expectations and requirements of Users.

10.3. We are not responsible for distortion, alteration, and misperception of the Content display on the Website, even if it caused a negative opinion about the User.

10.4. We are not responsible for failure or improper performance of our obligations as a result of failures in telecommunication and power networks, malware actions, as well as dishonest actions of third parties aimed at unauthorized access and/or disabling the Website software and/or hardware.

10.5. The content of the Website is for informational purposes only. We are not responsible for inaccuracies in the data and possible losses resulting from the use of the information from the Website.

10.6. We are not responsible for the content, authenticity, and security of the Content and Models/Materials, their components.

10.7. In the event of 3dbuy being held liable or fined in connection with violations of rights and/or interests of third parties (including copyright holders whose rights were violated by the User's or Author's actions), as well as prohibitions or restrictions established by law, the User must fully compensate 3dbuy for losses incurred as a result of such violation.

10.8. The User is not entitled to request any trading recommendations or other information motivating trading actions from 3dbuy representatives. The company undertakes not to provide the User with any recommendations directly motivating trading actions, except for issuing general recommendations on using trading strategies on the part of 3dbuy.

10.9. The User guarantees to protect 3dbuy from any liabilities, expenses, claims, damages arising directly or indirectly due to the User's failure to fulfill obligations to third parties, both in connection with their activity within the Company and outside it.

10.10. Materials presented on the 3dbuy.ru website are not copies of real, physical objects; these are not exact copies of copies, recreated by Authors in three-dimensional space from sketches of two-dimensional images available in the public domain or the Author's personal library. The material card content is filled in by the author concerning their 3D model for its classification and correct search display on the website.

10.11. 3dbuy is not responsible to the Client for delays and interruptions in work occurring directly or indirectly for reasons beyond the reasonable control of 3dbuy.

10.12. 3dbuy is not responsible for the quality of services necessary for the site's operation if organized by third parties not engaged by 3dbuy.

10.13. The User agrees that to work with the site, it is necessary to use software and equipment produced and provided by third parties; 3dbuy is not responsible for their quality.

10.14. The User agrees that no software is free from errors.

10.15. The User is solely responsible for the security and confidentiality of registration data: logins and passwords. All actions performed using the User's logins and passwords are considered performed by the User. The User is solely responsible to third parties for all actions performed using the User's logins and passwords. 3dbuy is not responsible for unauthorized use of the User's registration data by third parties.

10.16. The Parties are released from liability for full or partial failure to fulfill obligations under this Agreement if such failure is due to force majeure circumstances such as earthquake, flood, epidemic, military actions, and others. The Party for whom it has become impossible to fulfill obligations under this Agreement must notify the other Party within a reasonable time about the occurrence and cessation of these circumstances, confirming the presence of force majeure circumstances with a document from a competent authority.

10.17. 3dbuy has the right to unilaterally restrict the User's access to certain site functions or to the entire site completely if:
10.17.1 The User misleads regarding the use of content posted on the 3dbuy site;
10.17.2 The User repeatedly violates the terms of this Agreement;
10.17.3 Multiple complaints have been received regarding the User;
10.17.4 There are grounds to believe that the User engages in fraudulent or other illegal actions;
10.17.5 The User's actions or inactions damage 3dbuy's business reputation.

11. MISCELLANEOUS

11.1. The User must fully and unconditionally accept all provisions of this Agreement.

11.2. It is the only agreement between the User and 3dbuy regarding the use of the Website and Models/Materials by the User.

11.3. Each User may have only one Account, and any additional accounts may be deleted or temporarily blocked by 3dbuy.

11.4. The invalidity or insignificance of certain provisions of this Agreement shall not affect the remaining provisions of its content.

11.5. The rights and obligations of the parties may be transferred to other legal entities in case of succession.

11.6. The parties fulfill all obligations under this Agreement in the framework of a mandatory pre-trial claim procedure for resolving all possible disputes and disagreements.

11.7. Full information about 3dbuy is always available on its official website.

11.8. The User agrees to receive notifications and mailings from 3dbuy to the email specified during registration. The User may opt out of any mailing at any time, but some announcements and messages are mandatory for reading.

11.9. The Client is responsible for the security of their key data for accessing the Account and must immediately report access loss for blocking or restoring the Account.

11.10. The company reserves the right to delete the User's Account or reset the results of their trading activity in case of violation by the User of the terms of this Agreement, including but not limited to insults to company employees, violation of site rules, defamation, publication of false data or reviews, committing any other abuses against 3dbuy. Deleting the Account is equivalent to unilateral termination of this Agreement.

11.11. The use of trading robots or other similar tools on our platform is prohibited and will be sanctioned by the company.

11.12. Refunds are possible only if the User has not used the subscription, minus all payment system fees charged by the site's cashier and the platform through which the payment was made.

11.13. The main means of communication between 3dbuy and the User is correspondence through the personal account on the site, but the company may use other communication methods indicated on the official site.

12. RISK NOTICE

12.1. The User agrees to certain risks that may arise when using our platform, including:

12.1.1. General risks associated with potential loss of funds as a result of trading operations. These risks are not insured by the state, are not subject to any insurance under this Agreement or by an insurance company, and are not reimbursed by 3dbuy.

12.1.2. Risks associated with performing trading operations online, through an electronic trading system not directly related to global trading platforms. All communications are carried out via communication channels.

12.1.3. Risks associated with using electronic payment systems.

12.2. The User must understand that they should not make trading operations, purchase subscriptions (and other actions) with funds whose loss would lead to a significant deterioration in their quality of life or cause problems in relationships with third parties.

13. EXCLUSIVE RIGHTS

13.1. If you accept this Agreement, you also accept the waiver of exclusive rights to the uploaded Models/Materials. In the waiver of exclusive rights, the User explicitly states that they also grant the website or its owner the right to use, modify, and distribute these materials without restrictions. In addition, the waiver of exclusive rights may contain additional
